摘要:
家庭医生签约服务的主体认定问题是家庭医生制度发展的关键，将直接影响服务合同的性质、主体的权责义以及责任承担的界定。以英国为代表的“政府主导制”和以美国为代表的“市场主导制”家庭医生签约服务主体认定模式，对我国具有一定启示意义，应以“政府为主导、市场为辅助”，以部门规章的形式明确家庭医生签约服务的主体认定模式，并以立法方式规定签约主体的权责义。
Abstract:
The subject identification of family doctor contracting services is the key to the development of the family doctor system， which will directly affect the nature of the service contract， the rights and responsibilities of the subject， and the definition of responsibility. The “government-led system” represented by the United Kingdom and the “market-led” family doctors signing service principals model represented by the United States have certain enlightenment significance for China. Taking “government-led， market-assisted”， we should build department regulations to clarify the mode of identification of the main contract of the family doctor and stipulate the rights and responsibilities of the contracting party by means of legislation.
