摘要:
健康医疗数据共享是释放数据价值、驱动医疗创新的关键环节。基于利益相关者理论，健康医疗数据主体可分为数据贡献者、数据控制者、数据处理者和数据监管者，各主体在数据共享中面临不同的困境，主要表现为隐私保护不足、数据权属不清、数据资产化路径模糊及收益分配机制缺失。对此，国家层面应制定清晰的数据产权框架，厘清各主体的权责边界；建立动态知情同意机制，强化个人隐私保护；推动医疗机构数据资产化进程，健全公平的收益分配制度，从而系统性提升各方参与健康医疗数据共享的意愿，实现健康医疗数据共享的可持续发展。
Abstract:
Healthcare data sharing is a critical step in unlocking data value and driving medical innovation. Based on stakeholder theory, the key stakeholders in healthcare data can be categorized into data contributors, data controllers, data processors, and data regulators. Various stakeholders face different dilemmas in data sharing, primarily manifested as inadequate privacy protection, unclear data ownership, ambiguous paths towards data assetization, and a lack of benefit distribution mechanisms. In response, the government should establish a clear framework for data property rights to delineate the boundaries of authority and responsibility among stakeholders, create a dynamic informed consent mechanism to strengthen the protection of personal privacy, and promote the monetization of healthcare data within medical institutions to improve fair revenue-sharing systems. These measures will systematically enhance the willingness of all stakeholders to participate in healthcare data sharing, thereby ensuring the sustainable development of healthcare data sharing.
