摘要:
在数智时代，美国、英国、欧盟和日本等国家和地区通过明确数据权责、完善隐私保护与安全技术、健全多主体协同治理机制，在保障数据安全的同时促进了医保数据的规范利用。我国医保大数据治理虽已初步形成政策框架并开展地方实践，但在数据权属界定、技术支撑能力和跨主体协同机制建设等方面仍有不足。应借鉴国际经验，构建覆盖医保大数据全生命周期的法律权责体系，夯实统一标准与可控共享并重的技术基础，健全多主体协同、分级管理和可追溯的治理体系，推动医保大数据在安全可控的前提下实现规范、有序和高效利用。
Abstract:
In the digital intelligent era, countries and regions such as the United States, the United Kingdom, the European Union, and Japan have promoted the standardized use of health insurance data while ensuring data security by clarifying data rights and responsibilities, improving privacy protection and security technologies, and establishing robust multi-stakeholder collaborative governance mechanisms. China has preliminarily established a policy framework for health insurance big data governance and implemented local practices. However, there are still shortcomings in areas such as the definition of data ownership, technical support capabilities, and the development of cross-stakeholder coordination mechanisms. Drawing on international experience, China should establish a legal framework for rights and responsibilities covering the entire lifecycle of health insurance big data, lay a solid foundation for technical governance that balances unified standards with controlled data sharing, and improve a governance system characterized by multi-stakeholder collaboration, tiered management, and traceability. This will promote the standardized, orderly, and efficient use of health insurance big data under safe and controllable conditions.
