摘要:
鼓励社会资本办医是我国一以贯之的国策,在《基本医疗卫生与健康促进法》框架下，需要进一步明确公立医疗机构与社会资本合作办医的政策与法律边界,包括公立医疗机构与社会资本合作的可为模式和禁为模式。本文对公立医疗机构与社会资本合作办医的常见形式进行了合法合规性评析，并提出了完善立法的相关建议。
Abstract:
Encouraging social capital to run hospital is a consistent national policy of our country.Under the framework of the Basic Medical Care and Health Promotion Law,it is necessary to further clarify the policy and legal boundary of cooperation medical service between public medical institutions and social capital,including the feasible mode and prohibition mode of cooperation medical service between public medical institutions and social capital.This paper analyzes legal compliance of common forms of cooperation medical service between public medical institutions and social capital,and puts forward relevant suggestions for improving legislation.
