摘要:
目前我国重大疾病医疗救助主要存在法律制度缺失、职能归属模糊、基本概念界定不清等问题，法治化程度滞后。基于制度困境和现实问题，重大疾病医疗救助立法应坚持以公民权利与国家义务为基础、以法律与政策协调并用为形式的逻辑，厘清基本概念、确定行政主体分工、合理界定救助对象、完善行政程序。
Abstract:
At present,there are some problems in medical assistance for major diseases in China, such as lack of legal system,vague attribution of functions, unclear definition of basic concepts, and degree of legalization delayed.Based on institutional dilemmas and practical problems,it should be adhere to the basis of civil rights and state obligations,and legislative logic in the form of law and policy coordination in the legislation of medical assistance for major diseases.It should be clarify the basic concepts,confirm the division of administrative subjects, reasonably define the relief objects, and improve the administrative procedures in the legislation.
