摘要:
新冠肺炎疫情促进了传统医疗健康产业的转变，大规模、高普及的虚拟医疗服务逐渐兴起，患者信息共享安全与数据保护问题凸显。由此，数字健康的法律治理面临新的挑战——法律制度存在短板、法律政策落地困难、法律监管效果欠佳，需要运用法治手段来保障数字健康产业的发展。国家、地方、行业层面应共同完善法律、政策与制度，提升数字健康规制的规范性；通过协调适用“部门法”、专门设置监管机构、灵活运用监管手段、多元主体共同参与，提升数字健康规制的联动性；同时，树立全民网络安全和数据安全意识，打击数字健康网络犯罪行为，健全医疗健康大数据安全监管体系，提升数字健康规制的可控性。
Abstract:
The COVID-19 epidemic has facilitated the transformation of the traditional healthcare industry, with the gradual rise of large-scale and highly popular virtual healthcare services, and the issues of patient information sharing security and data protection coming to the fore. As a result, the legal governance of digital health faces new challenges, such as shortcomings in the legal system, difficulties in the implementation of legal policies, and ineffective legal regulation, which require the application of the rule of law to safeguard the development of the digital health industry. National, local and industry levels should work together to improve laws, policies and systems to enhance the normative nature of digital health regulation. Through the coordinated application of "sectoral laws", the establishment of special regulatory bodies, the flexible use of regulatory tools, and the participation of multiple entities, we could enhance the linkage of digital health regulation. It is necessary to build up the awareness of all people on cyber security and data security, crack down on digital health cyber crimes, and improve the regulatory system of medical and health big data security, so as to enhance the controllability of digital health regulation.
