摘要:
当前，健康医疗数据开放与个人信息保护之间存在矛盾，一是知情同意规则在健康医疗数据开放中适用不能，二是目的限制原则与医疗数据开放的定位相左。对此，将健康医疗数据分为完全开放和受控开放两类，对不同类型的健康医疗数据设置差异化的个人信息保护义务，实现健康医疗数据开放与个人信息保护之间的平衡。
Abstract:
At present, there is a conflict between healthcare data openness and personal information protection. One is that the rule of informed consent cannot be applied in healthcare data opening, and the other is that the principle of purpose limitation is contradictory to the positioning of medical data opening. In this regard, healthcare data should be divided into two categories: fully open and controlled open, and differentiated personal information protection obligations should be set for different types of healthcare data, so as to realize a balance between healthcare data openness and personal information protection.
